Terms and Conditions
Terms and conditions for using the Medpharm platform.

1. Provider and Scope
These terms apply to use of medpharm GmbH’s digital platform, Sendlingerstraße 41, 80331 Munich, Germany, info@med-pharm.de. The platform is for adults only. Medpharm provides the platform, not medical treatment or medical decisions.
2. Role of Medpharm
Medpharm provides technical infrastructure for patients, participating doctors and, where applicable, pharmacies. This includes accounts, digital medical histories, medical referrals, statuses, history, prescriptions, pharmacy selection and payments. No medical result or prescription is guaranteed.
3. Medical Service
Medical assessment is performed exclusively by a licensed doctor, who decides independently. Medpharm does not decide on prescriptions, medicines, dosage or treatment. Any doctor-patient relationship is governed by applicable law.
4. No Guarantee of Prescription Issuance
Payment or submission of a request does not create a right to a prescription. A doctor may reject it for medical reasons; this alone is not a platform error.
5. No Automated Medical Decision
Medical decisions are not made exclusively by automated means. Every request is individually assessed by a licensed doctor. Automated systems only organise the technical process.
6. Registration
An account is required. Users must provide complete, truthful identity, contact and health information and correct errors without delay.
7. Minimum Age
Only people aged 18 or over may use the platform. The actual date of birth must be provided. The pharmacy may perform additional age and identity checks.
8. Access Credentials
Credentials must be kept confidential and accounts may not be shared. Medpharm may temporarily block access if unauthorised use is suspected.
9. Medical Cooperation Duties
Users must provide all requested relevant medical information truthfully and to the best of their knowledge. Statutory liability rights remain unaffected.
10. Request Procedure
Normally, only one active medical request may exist at a time. New requests are initially shown in a limited view; after acceptance, the doctor receives the access needed for review.
11. Medical History
The doctor may view the documented medical history, including previous requests and decisions. Patients may also view it in their account.
12. Correction of Information
Users may correct or supplement their medical history. Material changes after a decision create a new request and do not automatically change the previous decision.
13. Doctor’s Decision
After individual review, the doctor may accept or reject a request and add reasons. Users can view the decision in their account.
14. Prescription
A prescription is issued only if the doctor considers it appropriate after individual assessment. Medpharm guarantees no prescription, medicine, quantity or suitability of a requested product.
15. Pharmacy
The prescription may be made technically available to the selected pharmacy. It receives only necessary data. Medpharm does not sell, store or ship medicines; the pharmacy decides on dispensing.
16. Medication Availability
Displaying a pharmacy or availability does not guarantee that a medicine can be dispensed. Availability may change and the pharmacy makes the final decision.
17. Prices
The total price is clearly shown before ordering. Additional costs are charged only when expressly shown before the contract is concluded.
18. Ordering Process
Before a paid order, essential contract information is provided and input errors can be corrected. The payment button clearly indicates the payment obligation.
19. Payment Processing
Payment is made through the offered methods and may use external providers such as Mollie. Available methods are shown during checkout.
20. Fees Following a Medical Decision
The fee relates to the stated service. Rejecting a prescription does not automatically create a refund right if the medical review or intermediary service was properly provided. Statutory refund, withdrawal and warranty rights remain unaffected.
21. Right of Withdrawal
Consumers generally have a statutory withdrawal right for distance contracts and receive separate information. Under statutory requirements, it may expire when a requested service is fully performed immediately.
22. Technical Availability
Medpharm aims for high availability but cannot guarantee uninterrupted operation. Maintenance, security, technical faults or external infrastructure may cause restrictions.
23. Medical Emergencies
The platform is not intended for medical emergencies and does not replace necessary examination or emergency care.
24. Prohibited Use
False identity or medical information, use of another account, sharing credentials, manipulation, bypassing security, automated attacks and unlawful use are prohibited. Serious violations may lead to suspension or closure.
25. Termination of the User Account
Users may request account closure. Statutory retention duties and existing rights remain. Medpharm may terminate for good cause, especially serious or repeated misuse.
26. Liability
Medpharm has unlimited liability for intent, gross negligence, personal injury, mandatory statutory liability and express guarantees. Otherwise, liability for slight negligence is limited to typical foreseeable loss where legally permitted.
27. Independent Activity of Doctors and Pharmacies
Doctors independently decide on medical care and pharmacies independently decide on dispensing. These terms do not exclude or limit statutory claims.
28. Data Protection
Processing of personal data is described in Medpharm’s separate Privacy Policy.
29. Changes to these Terms
Changes apply only prospectively. If they materially affect the contract or consent is legally required, Medpharm will obtain the necessary consent.
30. Consumer Dispute Resolution
medpharm GmbH is neither willing nor obliged to participate in consumer dispute-resolution proceedings unless legally required.
31. Applicable Law
German law applies. For consumers, this choice does not remove mandatory protection under the law of their habitual residence.
32. Final Provisions
Statutory provisions apply. The invalidity of one provision does not automatically invalidate the remaining provisions.
